    What Is a DBA in Delaware?

    A DBA stands for "Doing Business As." It is an alternative name your business uses instead of its registered legal name. In Delaware, the official term is "trade name."

    Any type of business can register a trade name in Delaware. This includes sole proprietors, general partnerships, LLCs, and corporations. The process is the same for each.

    A DBA does not create a new legal entity. It does not change your tax status, your liability protection, or your ownership structure. It is only a name your business is authorized to operate under.

    Delaware moved trade name registration away from the county Superior Courts. As of February 2, 2026, all new trade names are filed online through the Delaware Division of Revenue's One Stop portal. [1]

    Step 1: Search Your Delaware Trade Name

    Delaware requires your trade name to be distinguishable from every other registered business name and trade name on file. A name that is identical or confusingly similar to an existing trade name will likely need to be changed before it is accepted.

    Search for free using the Delaware Trade, Business and Fictitious Names Search tool, or check availability directly inside Delaware One Stop when you start your application. [3]

    Keep in mind that data can take up to 72 hours to update between One Stop and the search tool, so check One Stop directly if you plan to file soon. [3]

    Delaware DBA Name Rules and Restrictions

    Delaware's naming rules for trade names are simple, but the state does enforce them.

    Step 2: Get a Delaware Business License

    If your business operates in Delaware, apply for a standard Delaware business license through One Stop.

    If your business does not conduct business in Delaware but still needs a Delaware trade name, for example, to open a bank account or meet a contract requirement, apply for a Trade Name Only License instead. This license costs $25 and requires a Certificate of Good Standing from the Delaware Division of Corporations, which costs $50.     Once you submit your application, the Division of Revenue processes it digitally. Notarization is no longer required. [1]

    After approval, your trade name appears in the Division of Revenue's Trade Name Registry. If your trade name was originally filed with a county Superior Court before February 2, 2026, it remains valid and does not need to be refiled unless you want a Trade Name Certificate from the Division of Revenue.     Delaware trade names do not expire. You can use your registered DBA indefinitely. If you decide to stop using it, you can cancel it for free through One Stop. [1]

    DBA vs. LLC in Delaware: What Is the Difference?

    A DBA and an LLC are not the same thing. This is one of the most common points of confusion for new business owners, and getting it wrong can be costly.

    A DBA is only a name. It does not create a legal entity. It does not protect your personal assets. If someone sues your business, your personal finances are exposed.

    Forming an LLC means you are creating a separate legal entity. That separation generally protects your personal finances, home, and savings from business debts and lawsuits.
