To qualify, you must be a nonprofit that:

  • - has been organized under state law
  • - is operated for a 501(c)(3) purpose such as educational, religious, scientific, medical or other charitable causes
  • - benefits an unidentified charitable class of people
  • - engages in activities that are non-political in nature
  • - derives at least one-third of its support from the general public
Nonprofits aren’t automatically granted tax-exempt status. To receive this status, your organization must submit a 501(c)(3) application with the IRS.

Yes. The IRS may question your application if a large percentage of revenues go to salaries and reject your application. When this is the case, your organization is acting more as a for-profit entity for the benefit of the owners/employees.
The primary benefit is that you may accept donations from donors who can then deduct the donation on their federal income tax. Also, many states accept federal 501(c)(3) status to grant sales tax or state tax exemption status. Your entity can also avoid paying federal and state taxes. Finally, many grant-providing entities only award grants to 501(c)(3) organizations.
