Before beginning the tax-exempt application process, you will need to:

  • - Form a nonprofit entity
  • - Form a board (at least three unrelated individuals if you seek tax-exempt status with the IRS)
  • - Adopt appropriate bylaws
  • - Obtain an EIN
  • - Provide a budget (showing no profit) with detail about your activities

Swyft Filings’ team of experts can help you with each step in applying for a 501c3. Contact us today for more information.

To qualify, you must be a nonprofit that:

  • - Has been organized under state law
  • - Operates for a 501(c)(3) purpose such as educational, religious, scientific, medical, or other charitable causes
  • - Benefits an unidentified charitable class of people
  • - Engages in activities that are non-political in nature
  • - Derives at least one-third of its support from the general public

The IRS doesn't automatically grant tax-exempt status to nonprofits. Your organization must submit a 501c3 application with the IRS to receive this status.

If your nonprofit doesn’t take donations, you may not need to apply for 501c3 status. Unsure? Contact us, and we’ll help you figure out the necessary steps your nonprofit needs to take to function at its highest capacity.

There are a number of tax-exempt organizations recognized by the IRS. Not all of them allow for deductible donations, but the entity itself can benefit from tax-exempt status. Please be aware that some of the following entity types have restrictions on engaging in political activities and may be subject to more stringent disclosure requirements. Swyft Filings can help you with each one.

Some of the most common 501(c) entity types are:

  •         501(c)(3) - Religious, Educational, Charitable, Scientific, Literary, Testing for Public Safety, to Foster National or International Amateur Sports Competition, or Prevention of Cruelty to Children or Animals Organization
  •         501(c)(4) - Civic Leagues, Social Welfare Organizations, and Local Associations of Employees
  •         501(c)(5) - Labor, Agricultural, and Horticultural Organizations
  •         501(c)(6) - Business Leagues, Chambers of Commerce, Real Estate Boards, etc.
  •         501(c)(7) - Social and Recreational Clubs
  •         501(c)(8) - Fraternal Beneficiary Societies and Associations

Yes. The IRS may question your 501c3 application if a large percentage of revenues go to salaries and reject your application. When this is the case, your organization is acting more as a for-profit entity for the benefit of the owners or employees.

The primary benefit is that you may accept donations from donors who can then deduct the donation on their federal income tax. Also, many states accept federal 501(c)(3) status to grant sales tax or state tax exemption status. Your entity can also avoid paying federal and state taxes. Finally, many grant-providing entities only award grants to 501(c)(3) organizations.

We can usually help you prepare your documents in 3-5 business days. Once you file with the IRS, the IRS takes 3-6 months.

The IRS fee ranges between $275 and $600 depending on whether you qualify for the 1023EZ or the long form.
